DMCA Policy

Texas House Menu (“we,” “us,” or “our”), operating the website texashousemenu.com (the “Site”), respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), we will respond promptly to valid notices of claimed copyright infringement.

Texas House Menu is an independent informational fan guide and is not affiliated with, endorsed by, or connected to Texas Roadhouse, Inc. If you believe content on this Site infringes your copyright, please follow the procedure below and we will review and act on your request.

1. Reporting Copyright Infringement

If you are a copyright owner, or an agent authorized to act on the owner’s behalf, and you believe that material on the Site infringes your copyright, you may submit a written notice (a “DMCA Notice”) to our designated agent using the contact details at the end of this page.

2. Elements of a Valid DMCA Notice

To be effective under the DMCA, your notice must be a written communication that includes substantially the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works are involved).

Please note: Under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material is infringing may be liable for damages, including costs and attorneys’ fees. Do not make false claims.

3. Our Response

Upon receiving a valid DMCA Notice, we will act expeditiously to review the claim and, where appropriate, remove or disable access to the material alleged to be infringing. We may also notify the user who posted the material and provide them with a copy of the notice.

4. Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a written counter-notification to our designated agent. To be effective, your counter-notification must include substantially the following:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location where it appeared before it was removed.
  3. A statement, made under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your full name, mailing address, and telephone number.
  5. A statement that you consent to the jurisdiction of the federal court in the district where your address is located (or, if outside the United States, any judicial district in which the Site operator may be found), and that you will accept service of process from the person who submitted the original DMCA Notice or their agent.

Once we receive a valid counter-notification, we may restore the removed material within 10 to 14 business days unless the original complainant notifies us that they have filed a legal action seeking a court order to restrain the allegedly infringing activity.

5. Repeat Infringers

We maintain a policy of terminating, in appropriate circumstances, the access or accounts of users who are found to be repeat infringers of copyright. We reserve the right to remove any content and restrict any user at our sole discretion, with or without notice.

6. Fair Use and Informational Content
